<p>I didn&#8217;t expect that my post (<a href="http://propinoy.net/2011/07/13/the-very-sad-state-of-manila-zoo/">The Very Sad State of Manila Zoo</a>) will receive so much attention and cause Propinoy.net&#8217;s server to crash. &#8220;Manila Zoo&#8221; even trended worldwide on Twitter. I&#8217;m glad that it did because it caught the attention of Malacanang and Presidential Spokesperson Edwin Lacierda released the following statement <a href="http://www.gov.ph/2011/07/14/the-presidential-spokesperson-on-the-manila-zoo-july-14-2011/">in the Official Gazette</a>.</p>

<p>We share the concern expressed by concerned citizens over the condition in which animals are kept in the Manila Zoo. We have taken steps again to alert the Bureau of Animal Industry (BAI), which, under the provisions of Republic Act No. 8485, otherwise known as the Animal Welfare Act of 1998, places the animal welfare certification and regulation of zoos under the authority of the Director of Animal Industry and the Protected Areas and Wildlife Bureau of the DENR, pursuant to the provisions of Republic Act No. 9147 (Wildlife Protection and Conservation Act). As a response, the BAI, through the Committee on Animal Welfare, said that it continuously engages in a comprehensive discussion with the animal advocates, particularly on the condition of Mali the elephant and other animals in the zoo. They made a plan of action to uphold the welfare of the animals that should be led by zoo officials.</p>
<p>We have also communicated with the office of the City Mayor of Manila and are confident that Mayor Alfredo Lim will dialogue with concerned citizens. The City Mayor has directed Public Recreations Bureau Chief Engineer Deng Manimbo to receive assistance and support from concerned citizens. Those who may wish to help in raising funds or otherwise helping to restore the Manila Zoo may call telephone numbers 468-9498 and 383-6862.</p>
<p>It is noteworthy that concerned citizens have expressed the willingness to assist in any way they can, to help the Manila Zoo improve its facilities and raise its standards. We are encouraged by this demonstration of public spirit on the part of our fellow citizens. It is a positive sign that the citizenry wants to be part of the solution and not just point out a problem.</p></blockquote>
<p>I appreciate the quick response by the government but I&#8217;m jaded. How long will it take for BAI, DENR and City of Manila to act on this. The animals aren&#8217;t getting healthier and quick action is needed here. There is no time to play Chinese garters with bureaucratic red tape. I and most of the people I know are not willing to donate money when we don&#8217;t know where it will end up. What most of us are willing to do is volunteer. Personally, I would rather that Manila Zoo either close down then send the animals to a big sanctuary either in Palawan or another country, or that Manila Zoo be sold or partnered with a private company which can guarantee its maintenance and attention to the animals&#8217; welfare.</p>
<p>My friend Nix de Pano went to Manila Zoo this morning and took photos of the animals. I&#8217;ll try to update tonight about what she found out. My friends and I are planning to visit the zoo very soon and we are looking for a zoologist, ornithologist, herpetologist or any animal specialist who is willing to help us. <p>One last thing, it has come to my attention that Tagaytay Zoo is almost as decrepit as Manila Zoo, with animals lacking in food and sanitation. The government needs to look into this too and I will visit the zoo the next time I&#8217;m in Tagaytay to see how the animals are.</p>

<p><strong>Anthony Taberna:</strong> Senator, isa po sa mga katunggali ninyo ay may commercial na natatandaan na po ng mga bata, eto po at itatanong ko sa inyo, kayo po ba ay nakaligo na sa dagat ng basura?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Hindi pa ho yata.</p>
<p><strong>Anthony Taberna:</strong> Nag-pasko na ho ba kayo sa gitna ng kalsada?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Meron din ho yata nun, lalong lalo na po after Malacanang eh’, dipende ho kung saan aabutan. Pero ang nanay ko ho kasi talagang importante iyong Christmas eve na magkakasama kami, nung mag-asawa yung mga kapatid ko hanggang alas-diyes, so kadalasan ho kasama ho yung mga neighbors dun sa Times po.</p>
<p><strong>Anthony Taberna:</strong> Naniniwala po ba kayo na para makatulong ang isang kandidato o kaya ay naghahangad maging Pangulo sa mga mahihirap ay kailangan ngang maging mahirap?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Palagay ko ho mas importante naranasan ninyo yung naranasan nila, pag sinasabi sa bansa natin yung mahirap, sinasabi katarungan, hindi nga nabibigyan ng adequate na abogado, hindi nasusulong yung kaso, hindi naipapakita yung kanilang punto. Kami po ay dumaan sa panahon ng martial law, yung nag-accuse po sa tatay ko si Marcos, yung may tangan po dun sa mga opisyales ng militar na humusga sa kanya si Marcos, yung magre-reveal nung kaso si Marcos, eh’ talagang talo pa po yung kangaroo court. Talagang wala ka ng kalaban-laban, marami naman po kaming dinaanan na kami rin po ay naapi, so alam po natin kung ano yung nadarama ng mga naapi, so palagay ko naman ho ayaw nating maulit yung pang-aapi kaya naman tayo ay may supisyenteng eksperyensa na para labanan yung pang-aapi.</p>
<p><strong>Anthony Taberna:</strong> Pero yung pong sinasabi nilang kailangan mo munang dumaan sa pagiging gutom para malaman mo kung gaano kahirap ang maging gutom, kailangan mo munang… didiretsuhin ko na po, si Sen. Manny Villar, kailangan daw pong dumaan ka sa pagiging tindero ng hipon sa palengke para po malaman mo kung ano ang nararamdaman ng mga tindero, ganoon po ba yun?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Palagay ko naman ho lahat tayo hindi naka-inom ng lason pero alam natin na nakakamatay ang lason, wala hong may eksperiyensa na ang pag-inom po nung lason ay nabuhay, yun pong sinasabi niyang kuwento. Puwede namang dumaan ka doon mali naman yung leksiyon eh’ di wala rin hong silbi, ang point ko lang ho dito, when you are poor and you have so much of one thing for so many things, yung that is something that, yung people who have been deprived of whatever can also matter, can also be passionate about striving to changes.</p>
<p><strong>Anthony Taberna:</strong> Kayo po ay may mga pinapalabas naring mga TV advertisements, magkaano na ho ang inyong ginagastos?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Kailangan ko hong i-check dun sa ating accountant, hindi ho ako binibigyan ng running total, pero malayo ho dun sa mga katunggali natin, siguradong-sigurado po yun.</p>
<p><strong>Anthony Taberna:</strong> Kamusta ho ang pagdating ng tulong pinansiyal pagdating po sa politika para sa parating na halalan?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Maganda naman po, lalo na po nag-umpisa kami ng wala dahil hindi naman po ako nag-planong tumakbo, supisyente naman po para mapondohan yung ating mga sorties, yung mga political ads natin at tsaka maitulong dun sa mga volunteers natin.</p>
<p><strong>Anthony Taberna:</strong> Magastos po yan ano, ang sabi po doon sa inyong TV ad, hindi po kayo magnanakaw, mayroon po ba kayong pinatatamaan doon?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Mayroon po mga naku-kuwestiyon kung saan nga po napunta yung pondo ano, more than anything nga po ang hina-highlight natin dun, tayo naman po ay nanggaling na ng Malakanyang, tayo naman po ay nanging opisyales sa gobyernong ito hindi naman natin inaabuso yung kapangyarihan na naipag-kaloob sa atin at sa pagkakataon. Noong panahon na ang nanay ko po ang Presidente at ang tawag po sa akin ng mga kabarkada ko ay “tanga”. Nung tinanong ko po paano naging “tanga” dahil naka-deans list naman ho ako kahit papaano, eh’ ang sagot ho eh’, may pagkakataon kaming kumita, tumiba-tiba eh’ hindi raw namin sinamantala kaya raw po kami “tanga’, ganoon na nga lang po eh’ di’ thank you.</p>
<p><strong>Anthony Taberna:</strong> Pero dito po sa kasalukuyang bakbakan sa pagka-Pangulo, nung sinabi po ninyong hindi ako magnanakaw, magandang-maganda po ang dating nun, ang kahulugan po ba nito, yung ibang mga kandidato ay maaaring magnakaw o nagnanakaw.</p>
<p><strong>Sen. Noynoy Aquino:</strong> Tandaan po ninyo ang focus po namin ay ang kasalukuyang pamamahala, balikan po natin yung ZTE, yung ZTE po ayon sa board meeting ng NEDA P5 milyon dapat ang nagastusan dun sa backbone ng ZyberEd. Yun pong tinatawag ni Jun Lozada na “tong-pats” ang tinatantiya ay mga P14 billion, so P5 billion lang talaga yung proyekto yung paghahati-hatian nila P35 billion, hindi ho ba pagnanakaw yun? Yung pagde-deprive ng mga puwedeng naging eskuwelahan, ospital, kalsada, kuryente sa mamamayan. Imbes na kumuha na lamang ng kapiraso ng P5 million, naging importante yung dinagdag na times seven ho bale ang dagdag.</p>
<p><strong>Anthony Taberna:</strong> kayo po ay hindi magnanakaw, kami po ay maniniwala doon sa inyong pangako na iyon, pero paano po iyung mga nakapaligid sa inyo?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Kapag yung nasa itaas po ay magli-lead by example, kakabahan naman po maski papaano yung nasa ibaba at mayroon kayong moral superiority para habulin lahat ng hindi susunod. Pero minumungkahi po namin na hindi lamang lalabanan ang korapsiyon, pero bigyan naman natin ng pagkakataon yung matino na manatiling matino, Presidente po ng Republika P50,000 po ang suweldo, gross, ang pinapangasiwaang budget ay P1.5 trillion, baka mayroong matukso ho diyan kapag hindi maisagot ho yung tuition ng anak. Kailangan pong gayahin natin tulad ng Singapore na kung saan mataas-taas yung porsiyento ng private sector counterpart, sa Pilipinas po entry level pantay, pag na-promote na yung private sector ang layo na po ng agwat, so paano kapag ganoon na kataas yung super levy, sa ma mababa, mas mababa po talaga, medaling tuksuhin, kaya kailangan din po nating itaas ang antas na yun para makayanang labanan yung tukso.</p>
<p><strong>Anthony Taberna:</strong> Lahat po ng mga kasama ninyo ngayon, mga sumusuporta, mga pulitiko na lumapit po sa inyo at sumakay sa Liberal Party ay dumaan po sa pagsala para matiyak na, oh’ eto ay talagang hindi rin mangnanakaw.</p>
<p><strong>Sen. Noynoy Aquino:</strong> As much as possible po, pero pati naman pos a Bibliya ano, si Kristo nagsalita ng “those who have no sin cast the first stone”, sasabihin ko ho ba kami lahat dito ay Santo maski paanong husgahan, baka mayroon din yung may kasalanan, pero ang point ho nun, nanigurado kami na walang major na kasalanan. Wala naman pong perpektong tao.</p>
<p><strong>Anthony Taberna:</strong> Nangangamba po ang iba Senator na baka po kayo ay diktahan ng civil society na nag-upo rin noon kay Pangulong Arroyo matapos maalis si Erap pero iniwanan din po lumaon ito pong si Pangulong Arroyo, hindi daw po kaya ganito rin ang sapitin ninyo sa kanilang mga kamay?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Dapat po kasi open, mayroon akong idea, mayroong idea yung aking katunggali na baka pinagsama natin yan mas maganda yung produkto, at same time sa dulo po nito yung Pangulo ang may responsibilidad sa lahat ng desisyon na gagawin niya, so ako naman po kapag naharap ko yung magulang ko masabi ko sa kanilang tama yung ginawa ko, para masabi ko ho yun, hindi ako puwedeng diktahan nino man, pati nanay ko po. Baka nga may mapapahamak pag mayroon tayong death penalty na hindi naman pala dapat parusahan.</p>
<p><strong>Anthony Taberna:</strong> So kayo po ba ay papayag na madiktahan ng sinoman sa inyo pong pagpapasiya?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Ang reputasyon ko ho eh’ matigas ang ulo, so yun bang pati nung nasa House, dun sa mga kasamahan ko doon na nakasabay ko doon, mayroong sinasabi na ito ay majority decision, ako po ay hindi automatic na sumasama dun sa majority decision, eto ba kaya kong panindigan na desisyon o hindi, kapag hindi ko kayang panindigan hindi ho ako sumasama sa kanila.</p>
<p><strong>Anthony Taberna:</strong> Tutukuyin ko na po, isa sa grupo na malapit na malapit sa inyo ngayon ay yung kontrobersiyal na law firm na kung tawagin ay The Firm, ito po ay malaking papel sa administrasyong Arroyo mula po nung Day 1 at in fact naging abogado pa po sila sa marami ilang kaso ng katiwalian ng administrasyon ng Pangulong Arroyo si First Gentleman Mike Arroyo, ano po ang sagot ninyo doon sa mga obserbasyon nab aka kayo ay paikutan lamang ng mga ito?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Kung puwede ho nilang subukan, pero isa lang po ang kasama namin dun sa The Firm, si Nonong Cruz, dating kalihim ng tanggulang pambansa, yung lahat ng kasama ko ngayon, siguro kung kakilala nila ako, isama na ninyo yung mga ka-klase ko nung grade school, high school at college. Hindi ako puwedeng dinadala kung saan saan lang, sa palagay ko hindi tama, yung Lolo ko po nung high school ako ang sabi ay talagang napaka-importante na may barkada ka pero huwag kang nagpapadala, huwag kang kaladkarin, kailangan ikaw ang lider. Paulit-ulit ho sila ng ganoon, so again, lahat ho ng desisyon ko at the end of the day, kailangan kaya kong panindigan.</p>
<p><strong>Anthony Taberna:</strong> Kagabi po medyo napuyat kayo sa pagtalakay sa C-5 controversy, senator isang diretsang tanong, puwede po ba kayong mag-inhibit na lamang doon po sa pagsisiyasat na ito para po mawala na yung pangangatwiran na kayo ay namumulitika lamang ditto sa isyu laban kay Sen. Villar?</p>
<p><strong>Sen. Noynoy Aquino:</strong> Ang problema ho yung numero namin sa Senado, kasi ho kami ay 23 total, isa yung naka-kulong, 11-11 na nga ho ang puwedeng mangyari, walang desisyon, kailangan ma-resolve yung issue, kung hindi na ho kailangan yung partisipasyon ko pero maaaring na-resolve yung issue one way or the other baka puwede po nating pag-isipan yan. Pero uulitin ko po kung namumulitika ako ho dito, si Senator Alan Cayetano at si Gilbert Remulla mismo ang magpapatunay na umpisa-umpisa pa lamang ho at hanggang sa mga araw na ito, nakiki-usap ako kay Senator Villar, pumunta ka dito kung talagang wala kang kasalanan mapapakita mo yan, mabigyan ka ng karapatan mo na magkaroon ng proseso, kung saan puwede mong ipagtanggol yung sarili mo.</p>

<p>MANILA, Philippines—Be careful what you wish for.</p>
<p>Former President Joseph Estrada Thursday said he scolded former Sen.  Ernesto Maceda for coming up with that “kalokohan (nonsense)”.</p>
<p>Maceda, Estrada’s campaign manager, said on Tuesday that supporting  Estrada may be the Arroyo administration’s “only option” if it wants to  prevent an Aquino victory.</p>
<p>He came out with the scenario to explain how Estrada could still  overtake Sen. Benigno “Noynoy” Aquino III, a consistent front-runner in  the major surveys of presidential contenders.</p>
<p>Estrada would be sinking his own ship if he’s open to an alliance  with the Arroyo administration just to boost his chances against the  Liberal Party (LP) standard-bearer.</p>
<p>LP director general Chito Gascon Thursday had this bit of advice for  Estrada, in effect telling the 73-year-old opposition leader to junk the  Maceda suggestion.</p>
<p>Gascon said the widespread unpopularity of President Gloria  Macapagal-Arroyo would spell doom for any presidential candidate she  would support.</p>
<p>He cited as an example the falling survey numbers of Nacionalista  Party (NP) standard-bearer Senator Manuel Villar, who had been rumored  early in the campaign season to be Ms Arroyo’s “secret candidate” and  not administration candidate Gilbert “Gibo” Teodoro. The Villar and  Arroyo camps had denied forging an alliance.</p>
<p><strong>Unrepentant regime</strong></p>
<p>“Now that a clear win by Senator Noy is imminent, it could very well  be logical for this unrepentant regime to swing their support to former  President Estrada in an anybody-but-Noynoy game plan,” Gascon said in a  statement.</p>
<p>“But we all know that an Arroyo endorsement will only bring down  Estrada and help the chances of Sen. Villar instead, so I don’t think  this last card, a Plan C, is going to play out on May 10,” he said.</p>
<p><strong>Irritation</strong></p>
<p>In an Inquirer interview, an angry Estrada said he immediately  confronted Maceda after reading about the latter’s statement.</p>
<p>“How can that be! It irritates me just to hear that name (of the  President),” Estrada said in Filipino.</p>
<p>“She grabbed power and then threw me in jail,” said Estrada, who was  ousted in a people power uprising in 2001, detained for six years, and  convicted of plunder in 2007. His successor, Ms Arroyo, granted him  pardon a month after his conviction.</p>
<p>Estrada said Maceda issued the statement without his clearance, and  that his chief campaigner probably thought he could do that because “he  is older than me.”</p>
<p>The day the story came out, text messages began circulating claiming  that Estrada—not Villar—was now Malacañang’s “pet” in the presidential  derby. Estrada dismissed these as black propaganda.</p>
<p><strong>‘She almost ruined my life’</strong></p>
<p>“Maybe it’s Maceda-Arroyo,” he said, and not really “Villarroyo,” the  buzzword coined by critics to describe the alleged Villar-Arroyo  partnership.</p>
<p>Estrada said it would be “impossible” for him to accept help from  someone whom he had been denouncing in his campaign speeches as one of  the conspirators behind his ouster from Malacañang.</p>
<p>“I might as well lose than join her. She almost ruined my life,” he  said.</p>

<p>MANILA, Philippines &#8211; President Gloria Macapagal Arroyo&#8217;s  spokesman assured Thursday that Malacañang will not order the military  to intervene in case of a total failure of the automated elections.</p>
<p>&#8220;Mangyari man iyon ay there are are available remedies sa Comelec, sa  korte at Kongreso. May mga remedies na available (Assuming it happens  (total failure of elections), there are available remedies available in  the Comelec (Commission on Elections), the courts and in Congress. There  are available remedies),&#8221; deputy presidential spokesperson Gary Olivar  said in an interview over ABS-CBN&#8217;s Umagang Kay Ganda.</p>
<p>Olivar said Malacañang is confident that a total failure of elections  will not ignite a high level of unrest that &#8220;needs military  intervention.&#8221;</p>
<p>He also reiterated that President Arroyo will step down as scheduled  on June 30 even if the new president is not immediately proclaimed  because of the failure of the elections.</p>
<p>Despite fears of a complete failure of the automated polls, Olivar  said Malacañang is taking the Comelec&#8217;s word that it will push through  on May 10.</p>
<p>He said he had received an advisory that Comelec has already made an  assurance that all compact flashcards needed for the automated polls  will be ready &#8220;a few hours before elections.&#8221;</p>
<p>The Comelec, on the hand, had said that it is also banking on the  promise of the Smartmatic-TIM that there is enough time to finish  reconfiguring all the flashcards in time for the elections.</p>
<p><strong>Mass Comelec resignation</strong></p>
<p>Comelec Commissioner Lucenito Tagle, who admits he does not know the  technical details of the automated election system, said the poll body  &#8220;thinks&#8221; it can push through with the elections on May 10 because of  assurances by the Smartmatic-TIM.</p>
<p>If not all of the flashcards are reconfigured on time, Tagle said  automated elections in far-flung areas might not push through. He  assured that the Comelec is ready to hold special elections in far-flung  areas.</p>
<p>He added that all Comelec commissioners, including their chairman,  Jose Melo, are willing to resign if the automated elections completely  fail.</p>
<p>&#8220;Kung talagang palpak at walang magawa at may complete failure of  elections ay magre-resign kami (If the automated elections completely  fail we will resign),&#8221; Tagle said.</p>
<p>Election lawyer Romulo Macalintal told ABS-CBN&#8217;s Umagang Kay Ganda in  a separate interview that the holding of special elections is in  violation of the Synchronized National and Local Elections Law.</p>
<p>Macalintal insisted that the Comelec should just postpone the  elections for 15 days, which would be enough for the ultimate testing of  the Precinct Count Optical Scan (PCOS) voting and counting machines.</p>
<p>&#8220;So we can test the PCOS machines not only for the counting of votes,  but also for transmission,&#8221; the lawyer insisted.</p>
<p>Macalintal has resigned as President Arroyo&#8217;s election lawyer because  Malacañang is against his proposal to postpone the automated elections.</p>

<p>Binay, running mate of Pwersa ng Masang Pilipino presidential bet  former President Joseph Estrada, said the scenario is part of a “grand  scheme” that is certain to be exploited by the Arroyo administration.</p>
<p>“There is an engineered chaos. Nothing happens by accident under the  Arroyo administration. These very disturbing developments point to a  carefully laid out plan to create chaos at the polls on May 10 that  could lead to a failure of elections,” Binay said.</p>
<p>Binay said the widespread systemic failure of the precinct count  optical scan (PCOS) machines on Monday, the refusal of the Commission on  Elections (Comelec) to do a parallel manual count sooner than two  weeks, and the ruling against pre-proclamation protests are all part of  the groundwork for a general failure of elections.</p>
<p>He said he would personally lead street protests to defend democracy.</p>
<p>“I urge other  political parties to set aside politics and put up a common front.  Those who are behind this apparent grand scheme might not realize that  they are playing a most dangerous game,” Binay said.</p>
<p>Meantime, an umbrella organization of some 21 civil society groups  warned the Comelec of a possible no-proclamation scenario if the poll  body insists on deactivating the digital signature feature of the PCOS  machines.</p>
<p>The Convenors of the Compact for Peaceful and Democratic Elections  said Republic Act 8436 or the Automated Election System (AES) Law as  amended by RA 9369 specifically states that election returns should be  digitally signed in order to be regarded as official results. <strong>– With  Michael Punongbayan</strong></p>

<p>Catholic priest Father Robert Reyes, who has gained a reputation for  running to advocate causes he believes in, will not run this time but  refuse food, as he decried the pro-administration stand of a ranking  Church official who rejected people power if the May 10 elections fail.</p>
<p>Fr. Reyes on Wednesday announced he would go on a hunger strike from 10  a.m. on May 8 to 10 a.m on Election Day &#8220;to appeal to the Comelec for a  credible elections,&#8221; in the wake of increasing public concern caused by  the failure of counting machines in field tests this week.</p>
<p>At the same time, the “running priest&#8221; chided the Catholic church for  following what he called “the Malacañang line.&#8221;</p>
<p>Manila Archbishop Gaudencio Cardinal Rosales on Sunday rejected the  possibility of a people power uprising if the May 10 election fails or  is tainted by massive cheating, dismissing such calls as irresponsible  and “crazy, crazy, crazy.&#8221; (See: <a href="http://www.gmanews.tv/story/189939/cardinal-rosales-rejects-people-power-if-elections-fail" target="_blank">Cardinal Rosales rejects people power if elections fail</a>)</p>
<p>&#8220;Many Catholic churches are badly compromised, <em>kaya hindi na  kailangang mag-dalawang isip kung ano ang ibig sabihin ni Cardinal  Rosales noong isang araw na hindi siya magtatawag ng People Power</em> (so they didn&#8217;t need to think twice about what Cardinal Rosales meant  the other day about not calling for People Power). That is definitely  the Malacañang line. Unfortunately, the Church has become the mouthpiece  of this administration,&#8221; the running priest told reporters.</p>
<p>Reyes also joined the call for a manual count by the Concerned Citizens  Movement (CCM) led by lawyer Harry Roque, who had accused Defense  Secretary Norberto Gonzales of planning a military junta in case of a  failure of elections. <p>&#8220;The moral scandal here is that she [Macapagal-Arroyo] will stay in  power. This is the worst thing that could ever happen to us. It is like a  priest telling us, <em>ipagpatuloy mo ang kasalanan mo, basta ‘wag kang  papahuli, tayong dalawa lang ang nakakaalam</em> (continue your sinning,  just don&#8217;t get caught, only the two of us will know),&#8221; Reyes said.</p>
<p>&#8220;Gloria Macapagal-Arroyo is a public sinner. She should not even be  allowed to receive communion, but she receives communion from all the  bishops,&#8221; Reyes lamented.</p>
<p>Despite Cardinal Rosales&#8217; rejection of people power, Reyes urged the  rest of the Catholic Church to take a &#8216;pro-people&#8217; stand.</p>
<p>&#8220;<em>Ito ang malungkot, walang posisyon ang simbahang Katoliko</em> (This  is so sad, the Catholic church not having a position). And even if I  risk being excommunicated, I’d like to ask the bishops to [abandon  their] political loyalties to a corrupt and immoral president and decide  in favor of democracy and our people.&#8221;</p>
<p>Reyes joined the CCM&#8217;s calls to take protests to the streets in case of a  failure of elections.</p>
<p>&#8220;We’re reaching a point where people have to take a stand. If our  institutions are all badly compromised, people should go out to the  streets. <p>MANILA, Philippines &#8211; Presidential rivals Sen. Benigno  &#8220;Noynoy&#8221; Aquino III of the Liberal Party and Sen. Manny Villar of the  Nacionalista Party on Wednesday opposed proposals to postpone the May 10  polls, saying it may lead to President Gloria Arroyo extending her stay  in power or a leadership vacuum.</p>
<p>Lakas-Kampi-CMD standard-bearer Gilbert &#8220;Gibo&#8221; Teodoro also opposed a  postponement, calling it &#8220;irresponsible&#8221; since it had no legal basis.</p>
<p>At least three presidential candidates backed a proposal to postpone  the elections despite fears that it may lead to a failure to proclaim a  new president before the end of Arroyo&#8217;s term on June 30.</p>
<p>Presidential bets Joseph Estrada, Eddie Villanueva and Nick Perlas  supported the proposal of Atty. Romulo Macalintal, President Arroyo&#8217;s  election lawyer, to postpone elections for 2 weeks to allow the  Commission on Elections (Comelec) to fix glitches in the automation  process.</p>
<p>Villanueva and Perlas said delaying the elections for 2 weeks is  necessary to prevent the possible outbreak of violence if there is  widespread failure of the May 10 polls.</p>
<p><strong>Villar fears GMA term extension </strong></p>
<p>In a statement, Villar said postponing the elections &#8220;could result in  bigger problems, including a possible term extension of President  Arroyo.&#8221; He said the people &#8220;cannot allow any term extension for the  President.&#8221;</p>
<p>If the elections are deferred by 2 weeks as proposed by Arroyo&#8217;s  election lawyer, Villar warned that the Philippines may plunge into a  &#8220;political turmoil.&#8221;</p>
<p>&#8220;Nahihirapan na po ang mga kandidato. Talagang hinihintay na lamang  nila ang election. Kung i-extend naman iyan, ewan ko kung papaano  tatanggapin ng local officials,&#8221; he said in a phone interview with  DYHP-Cebu of the Radio Mindanao Network.</p>
<p>&#8220;While I hope things will go well with the automated elections, we  cannot help but feel anxious about the electoral exercise given the ways  things are now unfolding,&#8221; Villar said.</p>
<p><strong>Noynoy: No to postponement </strong></p>
<p>Aquino, who is leading in the presidential surveys, on Wednesday  pushed for a manual count of the elections and insisted that the voting  push through on Monday.</p>
<p>&#8220;Elections must push through on Monday, May 10, as mandated by law.  Our people want a new leadership,&#8221; he said.</p>
<p>&#8220;The risk of elections not pushing through at all becomes much  greater with a postponement.  It is our sacred obligation to say &#8216;NO&#8217; to  these proposals to postpone elections to a later date. Each  postponement increases the possibility of yet another postponement,  bringing us closer to a potentially disastrous crisis of a leadership  vacuum on June 30,&#8221; Aquino added.</p>
<p>The Liberal Party demanded the Comelec begin preparations for a full  manual count, which, it believes, can prevent a total failure of the  elections.</p>
<p>&#8220;We demand that Comelec begin preparations for a full manual count  and present their contingency plan to the public as soon as possible.  Under the law, this is allowed.  We know that they have made initial  preparations for a manual count.  Thus, there should be no obstacle to  prevent elections from taking place this Monday,&#8221; Aquino said.</p>
<p>&#8220;What is important is the integrity of the process and its final  outcome. If full manual counting is the practical solution, then let us  do it, no matter how long it takes to finish,&#8221; he added.</p>
<p><strong>Erap says &#8216;why not&#8217;? </strong></p>
<p>For his part, Estrada said he is amenable to a 10-15 day delay but  only if the Comelec reverts to a manual count of the elections.</p>
<p>&#8220;If there will be a delay, it should only be to put the manual  counting into effect. If there will be a delay of 10-15 days but this  will ensure clean and reliable elections, then why not? Anyway, within  15 days that is still within Arroyo&#8217;s term and the only fear of the  people is that her term will not be extended. So if the postponement is  just another 10 &#8211; 15 days but it will decrease the risks of fraud and  failure of elections, then we should consider it,&#8221; he said in a  statement.</p>
<p>For his part, Teodoro said postponing the election would be the  &#8220;height of irresponsibility&#8221; in the part of Comelec.</p>
<p>Teodoro urged Comelec to resolve the problems in poll automation. He  said the Comelec was given enough time to prepare a contingency plan for  manual elections.</p>
<p>Calls for a delay of the nationwide elections mounted Tuesday after  Comelec and poll machine supplier Smartmatic-TIM admitted that faulty  software in memory cards for more than 76,000 vote counting machines  would have to be replaced.</p>
<p><strong>Palace: Don&#8217;t blame us</strong></p>
<p>A Malacañang spokesman on Wednesday said he favored a postponement of  the election but backtracked after Comelec said the memory cards will  be replaced in time and the election will be able to go ahead.</p>
<p>Deputy presidential spokesman Gary Olivar also said the Palace should  not be dragged into the problems with the vote-counting machines.</p>
<p>He said critics should &#8220;remember that the Comelec is a constitutional  body wherein Malacañang cannot interfere and does not interfere in its  decisions and operations.&#8221;</p>
<p>&#8220;Those critics should look at their books and study the Constitution  before casting their blame on the Palace. We have been consistent in our  support and advocacy for fair, free, orderly and credible elections,&#8221;  Olivar said.</p>
<p><strong>Postponement allowed only for local polls?</strong></p>
<p>A noted constitutionalist and an administration senator, meanwhile,  opposed the suggestion to delay the May 10 polls.</p>
<p>Lawyer Joaquin Bernas, one of the framers of the 1987 Constitution,  said the Omnibus Election Code does not have a provision that allows a  delay in the national election.</p>
<p>&#8220;Section 5 of the Omnibus Election Code states that Comelec is  authorized to postpone in any local subdivision. There&#8217;s nothing in the  law about national election. It would seem the power is only in local  elections,&#8221; he said.</p>
<p>He said that while the issue can be brought before the Supreme Court,  many people may oppose the idea of a delayed election because they  distrust the Arroyo administration. &#8220;It will probably increase their  distrust in the system,&#8221; he said.</p>
<p><strong>Postponement and failure </strong></p>
<p>Sen. Miriam Defensor Santiago, meanwhile, said that while the Omnibus  Election Code does not allow postponement of elections nationwide, it  allows the Comelec to declare a failure of elections nationwide.</p>
<p>“There is a big difference between postponement of elections and  declaration of failure of elections.  In the case of postponement, the  law allows it only in a political subdivision, such as a town or a  province.  In the case of failure of elections, the law allows it  nationwide,” she told reporters.</p>
<p>Santiago also said that unlike postponement of elections, the  provision on failure of election allows the Comelec to call for a new  election within 30 days after the failure of elections.</p>

<p>MANILA, Philippines &#8211; Malacañang announced yesterday that  the administration will not meddle in the affairs of the Senate and it  is up to the senators to decide if they would elect a new Senate  president.</p>
<p>Deputy presidential spokesman and Press Undersecretary Rogelio Peyuan  referred to the proposal of re-electionist Sen. Miriam  Defensor-Santiago to elect a new Senate president as a guaranty in the  event no president would be proclaimed due to a failure of elections on  May 10.</p>
<p>“It’s up to them (senators) to do what they think needs to be done to  put in safeguards and security measures,” Peyuan told a news briefing.  “This is a matter for them to decide.”</p>
<p>He said President Arroyo has not yet received a formal request from  the Senate to call for a special session to allow the senators to elect a  new president.</p>
<p>Senate President Juan Ponce Enrile whose term will expire in June,  challenged other senators to bring in the numbers if they want him to be  replaced.</p>
<p>Enrile made  the challenge following persistent reports that some senators want to  replace the Senate leadership as a contingency in case of a failure of  elections.</p>
<p>“How? How can they do that? I’m ready to step down if they have the  number anytime but how can they do that. If they can ask the President  to call a special session between now and Friday, oh? We cannot have  sessions on Saturdays and Sundays,” Enrile said.</p>
<p>Among the senators, Senators Santiago, Edgardo Angara, Francis  Escudero, and Alan Peter Cayetano have been vocal over the need to  replace Enrile with a senator whose term ends in 2013. <strong><br />

<p>MANILA, Philippines &#8211; Former President Joseph Estrada  sees the May 10 presidential elections as fast shaping into a one-on-one  fight between himself and Liberal Party standard-bearer Sen. Benigno  Aquino III.</p>
<p>Speaking to reporters at the Pwersa ng Masang Pilipino headquarters  in Mandaluyong, Estrada said the latest Pulse Asia survey shows that he  has overtaken Nacionalista Party presidential candidate Sen. Manuel  Villar Jr. as Aquino’s main rival.</p>
<p>“While the latest Pulse Asia survey shows me dead-even with Senator  Villar at 20 percent and Sen. Noynoy Aquino leading the pack with 39  percent, three other polls show me at solo second to Senator Aquino and  ahead of Senator Villar,” he said.</p>
<p>Estrada said results of three other surveys commissioned by allied  groups also reflected a “steady, upward trajectory” in voters’  preference and acceptability of him.</p>
<p>On the other hand, Villar was shown at a “nosedive,” he added.</p>
<p>The  73-year-old Estrada said he could cause a major upset and win next  week’s presidential election.</p>
<p>“Aquino’s numbers have reached a plateau,” he said.</p>
<p>Estrada said Aquino must not be “so presumptuous” as to claim a  premature victory and threaten mass action if he does not win the  elections.</p>
<p>“That is very crazy,” he said.</p>
<p>“He might want to take a lesson from his mother to speak with more  humility.</p>
<p>“After all, the race is not yet over. May the best man win.”</p>
<p>Present at the briefing were Estrada’s vice-presidential running  mate, Makati Mayor Jejomar Binay, PMP campaign manager Ernesto Maceda,  and Senate President Juan Ponce Enrile.</p>
<p>Estrada identified the three surveys as the Magdalo survey held last  April 19 to 24, the Department of the Interior and Local Government  (DILG) survey from April 18 to 22, and an internal survey prepared for  Enrile, who is running for re-election under the PMP, held last April 23  to 25.</p>
<p>The Magdalo survey results reportedly showed Aquino leading the  presidential race with 39.6 percent, Estrada at solo second place with  24.8 percent, Villar at third with 23.6 percent, and Gilbert Teodoro,  Jr., with seven percent.</p>
<p>The survey had 2,266 respondents with a plus or minus 2 percent  margin of error, according to the PMP.</p>
<p>The DILG survey showed Aquino as front-runner with 41 percent,  Estrada second with 25 percent, Villar at third with 23 percent, and  Teodoro fourth with nine percent.</p>
<p>The poll had 6,000 respondents with a plus or minus 2 percent margin  of error.</p>
<p>Enrile’s internal survey conducted by his JAKA distribution company  showed Aquino again leading the race with 35 percent, Estrada second  with 25 percent, Villar at third with 17 percent, and Teodoro again at  fourth place with eight percent.</p>
<p>The poll used a base of 2,400 respondents with a margin of error of  plus or minus 2 percent margin of error.</p>
<p>Estrada said he believes preference surveys are an important part of  the campaign in that they serve to educate the voter.</p>
<p>“But more than the unsubstantiated charge that they play a role in  conditioning the minds of the people, they do serve the various  contenders in any exercise as vital inputs in internal political and  campaign guidance and decision making,” he said.</p>
<p>Enrile said the three surveys were more reflective of what they saw  in their campaign sorties nationwide, compared to the figures in the  Social Weather Stations survey of the past weeks.</p>
<p>“I was surprised,” he said.</p>
<p>“The (SWS) figures do not seem to jibe with what we have seen in the  field.”</p>
<p>Enrile said the SWS surveys showing Estrada at third place were  “surprising.”</p>
<p>Their campaign sorties are always jam-packed, he added.</p>
<p>Browsing at results of the Pulse Asia and three other surveys, Enrile  said the downtrend in the popularity and voters’ preference for Villar  seemed irreversible at this stage of the campaign, with only a week to  go before election day.</p>
<p>Meantime, Malacañang thanked Estrada yesterday for “supporting”  Teodoro.</p>
<p>Speaking to reporters, deputy presidential spokesman Gary Olivar said  it would also be good if the two candidates talk to clarify what  Estrada meant about working with Teodoro. <strong>– With Paolo Romero</strong></p>

<p>MANILA, Philippines &#8211; Senior Associate Justice Renato  Corona and three other contenders for chief justice are in the Judicial  and Bar Council (JBC)’s shortlist to be sent to President Arroyo  tomorrow.</p>
<p>The eight-member collegial body led by retiring Chief Justice Reynato  Puno decided to submit the shortlist with the names of four candidates –  Corona, Supreme Court Associate Justices Teresita Leonardo-de Castro  and Arturo Brion, and Sandiganbayan acting Presiding Justice Edilberto  Sandoval – following an SC decision last month allowing the President to  appoint Puno’s successor.</p>
<p>This developed as the Supreme Court (SC) said yesterday that the  President could not appoint a new chief justice until a vacancy is  created, which is on May 17.</p>
<p>The statement was issued in reaction to a Malacañang pronouncement  that the President would appoint Puno’s replacement before the elections  on May 10. A court spokesman said Puno did not intend to retire before  May 17.</p>
<p>Corona, De Castro and Brion each got the unanimous nod of members of  the JBC with eight votes, while Sandoval got seven.</p>
<p>Apart from  Puno, the other members of the JBC are Justice Secretary Alberto Agra,  Sen. Francis Escudero, Rep. Matias Defensor Jr., retired SC Justice  Regino Hermosisima Jr., University of Sto. Tomas dean emeritus Amado  Dimayuga, Justice Aurora Santiago Lagman and Integrated Bar of the  Philippines representative J. Conrado Castro.</p>
<p>Castro, who missed the meeting but submitted his vote to Puno before  leaving for a vacation abroad, did not vote for Sandoval.</p>
<p>All four nominees submitted themselves to the screening process of  JBC and attended the public interview in Baguio City last April 19.</p>
<p>The JBC did not include two other nominees for the post – Senior  Associate Justice Antonio Carpio and Associate Justice Conchita  Carpio-Morales &#8211;who manifested their lack of interest in the post due  to their stand that Mrs. Arroyo is not allowed by the Constitution to  make the appointment.</p>
<p>In a press conference, SC spokesman Midas Marquez explained that the  JBC opted to submit the shortlist to the Palace on May 5 so as to give  the Philippine Bar Association (PBA) a chance to pursue its second  appeal on the March 17 ruling of SC in today’s last full court session  before the magistrates take a recess for the elections next week.</p>
<p>“The JBC is bending backwards for PBA. But the JBC can’t wait  forever. If they failed to file that second motion for reconsideration  before 9 a.m. or if it would be noted without action, then the JBC will  submit the shortlist on Wednesday,” he stressed.</p>
<p>“The JBC does not see the need to delay these proceedings any  further,” he added.</p>
<p>Marquez also rebuffed a reported statement of the Palace that Mrs.  Arroyo would make the appointment before the automated elections on May  10.</p>
<p>“I don’t see how a chief justice can be appointed when the position  is not yet vacant. There can’t be two chief justices at the same time.  When there’s no vacancy there can be no appointment made,” he stressed.</p>
<p>The SC official also assured the public that Puno would not leave the  SC until his retirement on May 17.</p>
<p>“Whoever will succeed can’t even take his oath while the retiring  chief justice is still around,” added Marquez.</p>
<p>However, he admitted that the period for the appointment by Mrs.  Arroyo was not touched in the SC ruling because “it was not an issue.”</p>
<p>Marquez said he does not know what the basis of deputy presidential  spokesman Gary Olivar was in suggesting the appointment of the next  chief justice before election day: “We leave it up to them.”</p>
<p>In a decision last March 17, the SC ruled that positions in the High  Court are exempted from the ban on midnight appointments under Article  VII Section 15 of the Charter, giving Mrs. Arroyo the power to name the  successor of Puno.</p>
<p>The Court, in a resolution last April 20, affirmed this ruling and  junked motions for reconsideration filed by parties. Marquez said this  made the SC decision final.</p>
<p><strong>GMA to act quickly on shortlist</strong></p>
<p>Meanwhile, President Arroyo would act quickly on the shortlist of  candidates for chief justice once it is submitted by the JBC, Malacañang  said yesterday.</p>
<p>Olivar also said Mrs. Arroyo would not be affected by last-ditch  attempts to stop her from naming the successor of Chief Justice Puno.</p>
<p>“Since all four names have been floated for a while now, this has  given the President a head start in arriving at a well-considered choice  from among these eminently qualified candidates,” Olivar told a news  briefing.</p>
<p>“We can expect a decision soon,” he said.</p>
<p>He said ideally Puno’s successor should be named before the elections  this coming Monday because of the possible filing of electoral protests  before the Presidential Electoral Tribunal (PET) that would be headed  by the chief justice.</p>
<p>Olivar hit the groups planning to file another motion for  reconsideration before the SC, saying they could have some hidden  agenda.</p>
<p>“Why are they insisting (on blocking Mrs. Arroyo to appoint the chief  justice) when the SC already ruled twice against them? She is stepping  down so there is no debt of gratitude. Maybe they want to install their  own chief justice who will be indebted to them,” he said.</p>
<p><strong>SC will be tainted if GMA appoints next CJ</strong></p>
<p>Rep. Satur Ocampo of the militant party-list group Bayan Muna  yesterday said that the SC will be tainted if President Arroyo appoints  next chief justice.</p>
<p>He said people would call the tribunal an “Arroyo Court.”</p>
<p>Ocampo lamented that the JBC, which is supposed to be an independent  body, apparently gave in to the prodding of Malacañang for it to submit  its shortlist of nominees for the next chief justice.</p>
<p>“Mrs. Arroyo will appoint anyone who will have a debt of gratitude to  her and her administration and hence shield her from legal  accountability when the time comes for her to face charges for her  crimes committed in office,” he said.</p>
<p>Even if Carpio is included in the JBC list, there are speculations  that Mrs. Arroyo prefers Corona to him. Carpio wrote the October 2006  court decision junking the administration’s Charter change campaign  through the people’s initiative mode, labeling it as a “gigantic fraud”  and a “grand deception.”</p>
<p>Several groups, including lawyers’ organizations, have urged Corona  to back out of the nomination process for next chief justice because of  his close association with Mrs. Arroyo and the fact that his wife has  been appointed by the President as an officer in a state corporation.</p>
<p>Meanwhile, Bagumbayan presidential bet Sen. Richard Gordon yesterday  said that although he personally does not agree with the appointment of  the new chief justice by Mrs. Arroyo before she steps down next month,  he respects the decision of the SC.</p>

<p>Meanwhile, four senatorial candidates of the Pwersa ng Masang  Pilipino (PMP) yesterday said that President Arroyo should give the next  president the chance to appoint a new chief justice.</p>
<p>In an interview with STAR editors, lawyer JV Bautista said there is a  need for a “new dispensation” both in the national government and the  Supreme Court.</p>
<p>Bautista, running under President Estrada’s political party PMP, said  the justices of the High Court who signed the resolution favoring the  contention that Arroyo has the authority to appoint the new Chief  Justice “lack a sense of delicadeza.”</p>
<p>He said the interpretation of the Supreme Court justices’ on the  Constitution is what prevails today.</p>
<p>“I think what is lacking there is the sense of delicadeza among the  members of the Supreme Court. If you will check on the records of those  who favored the ruling that Arroyo has the authority to appoint the new  chief justice is that they are the most recent appointees of the  president,” Bautista said.</p>
<p>For his part, former senator Francisco Tatad said there’s no need to  interpret the Constitution to guide and enlighten the justices in their  ruling on the authority of the President to appoint the new chief  justice during the 90-day ban on appointments before the election.</p>
<p>“What you need is to read the Constitution correctly. You don’t have  to interpret the Constitution. The Constitution is very clear. The  vacancy has to be filled within 90 days, fill up the vacancy before the  90 days ban,” Tatad said.</p>
<p>PMP senatorial candidate Rodolfo “Jun” Lozada said the High Tribunal  can elect an acting chief justice from among themselves.</p>
<p>“The justices have probably been pressured. It’s payback time for  debt of gratitude. The SC justices should appoint a chief justice, but  they come up with the ruling probably because they are forced to pay  back their debt of gratitude,” Lozada said.</p>
<p>Of the four, only Senate President Pro Tempore Jose “Jinggoy” Estrada  gave a submissive statement to the High Court’s ruling.</p>
<p>“We can stage rallies and so forth. But we cannot really do anything  about it anymore. The Supreme Court is the court of last resort,”  Estrada said. <strong>With </strong><strong>Paolo Romero, Jess Diaz, Jose Rodel Clapano</strong></p>
